GAMEYARD PARTICIPANT WAIVER & ASSUMPTION OF RISK

In this waiver, “Gameyard” means Gameyard Inc.

For participants under 18, this waiver must be accepted by a parent or legal guardian.

  1. About the activity

Gameyard runs coach-led laser tag events at indoor and outdoor locations, including homes, schools, gyms, parks, community spaces, offices, and rented venues.

The activity may include safety briefing, movement within the play area, use of infrared taggers and wearable sensors, light foldable field items, team-based gameplay, and entering and leaving the play area.

The activity is non-contact and uses no projectiles. Base Zones are no-fire.

  1. Participation requirements

Participation is generally for ages 6 and up.

Participants must:

  • be able to take part safely
  • follow Gameyard instructions at all times
  • wear suitable closed-toe shoes
  • remove loose items or jewelry that may create a safety risk

Gameyard may refuse, restrict, pause, or end participation if Gameyard believes participation is unsafe or rules are not being followed.

  1. Health acknowledgement

Do not participate if a medical condition, illness, injury, impairment, or other issue makes participation unsafe.

Stop immediately and tell a Gameyard coach if you feel unwell, dizzy, faint, short of breath, injured, or unable to continue safely.

If the participant has medication or a medical device relevant to emergency care, the participant or parent/legal guardian is responsible for making sure it is available.

Gameyard staff are not medical professionals and are not required to administer medication.

  1. Assumption of risk

I understand that participation involves risks, including:

  • slips, trips, falls, and loss of balance
  • sprains, strains, and impact injuries
  • accidental contact with people, field items, surfaces, walls, or equipment
  • uneven, hard, wet, grassy, paved, or changing surfaces
  • risks related to moving in and out of the play area
  • unexpected movement by other participants
  • site or weather conditions at outdoor or mobile events

I understand that these risks cannot be completely eliminated.

I voluntarily accept these risks in connection with participation.

  1. Release of liability for adult participants

If I am an adult participant, I release Gameyard and its directors, officers, employees, contractors, coaches, volunteers, representatives, and agents from claims arising from or related to my participation, including claims for injury, death, property damage, or other loss, including claims based on ordinary negligence.

This release does not apply to gross negligence or wilful misconduct.

  1. Minor participants — parent/legal guardian consent

If I am accepting this waiver for a participant under 18, I confirm that:

  • I am the participant’s parent or legal guardian
  • I consent to the participant taking part
  • I understand the risks described in this waiver
  • I will review the rules and safety instructions with the participant
  • I release any claims I may have in my own personal capacity arising from the participant’s participation, except to the extent caused by Gameyard’s gross negligence or wilful misconduct

I understand that this waiver is not intended to waive any rights that cannot legally be waived on behalf of a minor.

  1. Rules and removal from play

All participants must follow Gameyard’s written and verbal rules and all coach instructions.

Participants must not:

  • push, tackle, strike, or intentionally make physical contact with others
  • run into others
  • engage in horseplay or unsafe behaviour
  • climb, stand on, or misuse field items
  • bring unsafe or prohibited items into the play area
  • block exits, aisles, or entrances

Gameyard may remove a participant from play if Gameyard decides the participant is acting unsafely, is impaired, is disruptive, or is not following instructions.

  1. Impairment and prohibited items

No participant may take part while impaired by alcohol, cannabis, illegal drugs, or any other condition that makes participation unsafe.

No personal weapons, laser pointers, unauthorized electronics, glass items, food, or gum are allowed in the play area.

  1. First aid and emergency response

If Gameyard reasonably believes emergency help is needed, I authorize Gameyard to provide or arrange basic first aid, contact emergency services, and share relevant information with emergency responders.

Any medical or related costs remain the responsibility of the participant or parent/legal guardian.

  1. Personal property

Participants are responsible for their own belongings.

Gameyard is not responsible for lost, stolen, or damaged personal property, except to the extent directly caused by Gameyard’s gross negligence or wilful misconduct.

  1. Insurance notice

Gameyard carries commercial liability insurance for its operations.

This waiver does not change or guarantee any insurance coverage.

  1. Electronic acceptance

  1. Governing law

This waiver is governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.

  1. Severability

If any part of this waiver is found unenforceable, the remaining parts will continue to apply to the fullest extent permitted by law.
