Gameyard Inc. (“Gameyard”, “we”, “us”). If “Gameyard” appears alone in this document, it means Gameyard Inc. (Ontario corporation).
Read carefully — this affects legal rights. If you are under 18, your parent/legal guardian must accept the Minor & Guardian Consent below before you play.
1) Activity Description
Participation in an active, indoor laser-tag game using infrared taggers and wearable sensors. Static indoor cover pieces (foam or sealed, non-ride props) are used and secured by floor-safe weights. There are no projectiles, no contact, and no fog/strobes. Base Zones are no-fire.
2) Health & Fitness
You must be physically able to participate and follow all instructions. Do not participate if a medical condition, illness, injury, or impairment makes participation unsafe. Wear indoor non-marking shoes and remove loose items/jewelry.
3) Assumption of Risks
You understand the inherent risks of an active game, including slips, trips, falls, collisions with objects or people, sprains/strains, and impact with the floor or equipment, as well as risks inherent in group activity in a gym setting. To the fullest extent permitted by law, you freely and voluntarily accept all such risks, known and unknown, including those that may arise from the ordinary negligence of GameYard, any Venue, and their officers, employees, contractors, and volunteers.
4) Release of Liability (Adult Participants)
To the fullest extent permitted by law, you release, waive, and forever discharge GAMEYARD, any Venue, and their officers, directors, employees, contractors, and volunteers from any and all claims, liabilities, demands, actions, costs, or expenses arising out of or related to any loss, damage, or injury you may suffer in connection with participation, including claims based on ordinary negligence and any duty of care owed by an occupier of premises, except for gross negligence or wilful misconduct.
5) Indemnity
You agree to indemnify and hold harmless GAMEYARD and the Venue from claims brought by you or on your behalf, or by third parties, arising from your acts or omissions or violation of rules, including legal fees and costs, to the fullest extent permitted by law.
6) Rules and Removal
Follow all written and verbal rules, including no running into others, pushing, tackling, horseplay, climbing, or standing on cover pieces; keep exits and aisles clear; follow coach instructions. You may be removed from play without refund if you do not comply.
7) Medical Consent
You consent to GAMEYARD providing basic first aid and to emergency medical treatment if required, and you are responsible for related costs. Promptly report any injury or incident to a coach.
8) Personal Property
You are responsible for your personal belongings. GAMEYARD and the Venue are not responsible for loss, theft, or damage to personal property.
9) Minors — Guardian Consent
For Participants under 18, a parent or legal guardian must accept the following before play:
Authority & Consent. You are the Minor’s parent/legal guardian and consent to participation.
Risks & Rules. You have reviewed sections 1–3 with the Minor; the Minor will follow the rules and coach instructions.
Assumption of Risks (Guardian). You accept the risks in section 3 on the Minor’s behalf to the extent permitted by law.
Release/Indemnity. You release on your own behalf (not on the Minor’s behalf) claims arising from or related to the Minor’s participation, except for gross negligence or wilful misconduct; and you agree to indemnify GAMEYARD and the Venue for third-party claims and for claims arising from the Minor’s breach of rules or intentional misconduct, except to the extent caused by GAMEYARD’s negligence.
Note: A parent/guardian’s acceptance may not bar a Minor’s own negligence claim under Ontario law. This Consent documents informed risk acceptance, rule compliance, and the guardian’s own release/indemnity.
10) Electronic Acceptance
By clicking “I agree”, you are signing electronically. A copy of this Waiver will be emailed for your records.
11) Medical conditions, medications, and devices
• Consult a clinician before participating if you have heart or respiratory conditions, seizure disorders, back/neck/joint issues, recent injury, surgery, or concussion, or if you are pregnant.
• If you carry prescribed medication (e.g., inhaler, epinephrine auto-injector), bring it and be able to self-administer; tell a coach where it is. GAMEYARD staff are not obligated to administer medications but may assist while 911 is contacted in an emergency.
• If you have an implanted or wearable medical device (e.g., pacemaker, ICD, insulin pump, hearing implant), consult your clinician regarding participation; ensure any vest is worn comfortably and not tightly over the device.
12) Substances and prohibited items
• No alcohol, cannabis, illegal drugs, or impairment on or near the field. You may be removed if impairment is suspected.
• No personal weapons, laser pointers, or unauthorized electronics.
• No food, gum, or glass on the field.
13) Venue surfaces and environmental conditions
• Indoor surfaces may include wood, sport tile, vinyl, or concrete with mats; edges, seams, or transitions can be uneven, and cones and cover pieces create obstacles. Choose a pace suited to conditions. Immediately report spills, loose debris, or hazards to a coach.
